Orders are placed via the Website according to the methods illustrated below:
› When you are ready to make a purchase, click on 'add to cart' to add the Product you intend to purchase to your cart. Then continue by clicking on 'proceed to purchase' to access our secure servers to complete your Order.
› If it is your first purchase on the Website, at the end of the payment operations you can decide to create an account with us using your e-mail address; in this case you will be asked to create a password. The password must remain secret and must not be communicated or shared with anyone else. A secure password storage tool is set up to allow you to recover it if you lose it during future purchases. You will then be asked to indicate your address. › The Contract concerns exclusively the Product(s) whose shipment has been confirmed by sending the Shipping Email. We will not be required to supply any further Products included in the Order until the shipment of said Products is confirmed with a separate Shipping Email.
› Please check the confirmation email and the shipping email for greater security and immediately report the presence of any errors.
› If problems are encountered with your Order, you will be contacted by a representative of Peroso Gioiellieri dal 1891.
Prices and shipping costs may be subject to change at any time, without prejudice to Orders already confirmed with the sending of the Shipping Email.
Prices are checked regularly. However, if we discover a change or error in the price upon receipt of your Order, we will contact you to verify that you still intend to proceed with the purchase by applying the correct price. In the event of your confirmation to this effect, please remember that this does not imply any obligation on our part to supply the Product(s) until the Shipping Email confirming the Order is sent.
The prices of the Products indicated on our Website at the time of check-out include all taxes (including VAT) payable on the purchase of the Products, but excluding shipping costs, which will be automatically applied to the total amount when the contents of your cart and any taxes for countries outside the EU.
All payments are due upon shipment of the Product(s). Payment for the Product(s) must be made by credit or debit card. We accept payments via Visa, MasterCard, American Express and Maestro cards. If we are unable to accept your Order for any reason, we reserve the right to choose whether to refuse your debit or credit card or to refund any sums paid in respect of your Order. Delivery of the Product(s) will take place at the address indicated by you in the Order within the deadline communicated in the Shipping Email, but it is not possible to guarantee an exact delivery date.
If the Product(s) has not been delivered within 35 days of the Contract or on such other date as may be agreed, you will have the right to withdraw from the Contract and any sum paid by you will be refunded to you without further delay.
Title and risk in the Product(s) pass to you upon delivery.
Upon delivery you are required to inspect the Product(s) for any defects or damage. If you discover any defects or damage to the product caused by a manufacturing error, you should report it as soon as possible and we will arrange for the relevant return to our Customer Service Center, at no cost to you. If it is ascertained that the damage to the Product(s) occurred before delivery, or that the defect is not attributable to your fault or use, we will repair or replace it or refund the full price paid by you , including any shipping costs, provided that the damage does not arise from wearing or using the Product(s). If you prefer repair or replacement of the Product(s), please contact us and we will replace the item without further charge where this is reasonably possible. In addition, we will reimburse you for the costs incurred in returning the item or we will send you a pre-paid package to return the damaged or defective item. In the event of a lack of conformity of the Products pursuant to Article 129 of the Consumer Code, the legal guarantees referred to in Articles 129 et seq. apply. of the Consumer Code. You have the right to have the conformity of the goods restored, free of charge, through repair or replacement. In case of impossibility to carry out the above remedies, you have the right to an adequate reduction in the price of the products, or to the termination of the contract. These rights are considered waived if any lack of conformity is not notified within 30 days from the date on which it was discovered. Our responsibility extends to the discovery of any lack of conformity within two years of delivery of the products. In any case, the right to take action aimed at ascertaining any defects of conformity, unless maliciously concealed by us, automatically ceases twenty-six months after delivery of the products.
While every effort has been made to represent the Product(s) as accurately as possible through the use of photographs and other images provided on the Website, some items may appear slightly larger or smaller than their actual size due to defects in the screen or photographic techniques used. Other items may be represented on a larger scale than their actual dimensions so as to highlight all the details, or on a smaller scale so as to show the object in its entirety. Furthermore, the details displayed on the screen (such as colours, designs, textures, etc.) depend on the characteristics of the device used and therefore may not faithfully reflect the real properties of the Products that will be delivered to you. Furthermore, being artisanal products made entirely by hand, they will never be identical to the Product(s) viewed on the website.
These Conditions of Sale do not exclude our possible liability towards you for the following events:
› damage to people or death resulting from our fault;
› fraud or contractual fraud;
› violation of the rules of the Consumer Code; or other events for which we are not permitted to exclude (or attempt to exclude) our liability.
We are not responsible for any delay or failure to perform our services under the Contract if this is due to causes not attributable to us.
Please note that no clause contained in these Conditions of Sale may in any case prejudice the rights to which you are entitled under the law.
Subject to the detailed terms and conditions, if you are a consumer (i.e. if you are not purchasing, in whole or in part, for purposes relating to commercial, entrepreneurial, craft or professional activities), pursuant to Article 52 of the Consumer Code you have right, in addition to the other rights to which you are entitled, to withdraw from this Contract without just cause and to receive a refund of the price paid including any shipping costs (any shipping costs incurred by Peroso Gioiellieri dal 1891 will not be reimbursed).
You may withdraw from the Contract at any time before the Order is delivered to you and up to 30 days after that date, starting from the day of purchase of your Order (the "Cooling-Off Period").
To exercise the right of withdrawal, you are required to give unambiguous communication by registered mail, preferably in writing:

If you decide to withdraw from the Contract, you are required to return the Product(s) following the instructions you will find inside the package.
The products must be returned within 30 days from the date of purchase or within 14 days from the notification of withdrawal, in the same conditions in which you received them. If you do not return the product(s) within the timescales set out above, and in accordance with the instructions included in the package, we reserve the right to collect the goods from you at your expense.
You are required to exercise due diligence in caring for the Product(s) in your possession. In the event of non-compliance, we reserve the right to deduct the cost of any deterioration of the Product(s), up to the price, from the amount to which you would otherwise be entitled as a refund.
We recommend that you ensure that the Product(s) are adequately insured for transport.
Only some returns can be accepted, except those in concession and those present at airports. Returns will be subject to the store's terms and conditions. We invite you to contact the store to inquire about the policies adopted.

If the Product(s) are returned according to the terms indicated, we will refund you the full price of the Products (subject to any deductions due due to use and damage to the Product) as well as the standard shipping costs paid .
The refund will be made within 14 days from, respectively:
› if the Products have not been delivered to the shipping address indicated by you, within 30 days of the conclusion of the Contract; or - from the sending of our confirmation via e-mail that your Order has been cancelled; or - if the Products have been delivered to you, from receipt of the Products returned by you or, if earlier, from the day on which proof is provided that you have returned the Products.

These Conditions of Sale and any other document expressly referred to therein constitute the entire agreement between the parties with reference to the object of the Contract. The Contract and any further communication between the parties will be formulated in Italian.
The form, existence, construction, execution, validity and any other aspect of these Conditions of Sale or any of the clauses contained therein are governed by Italian law.
Any disputes regarding the interpretation, validity or execution of these Conditions of Sale are submitted to the exclusive jurisdiction of the competent court in the place of residence or domicile of the consumer.
You have the right to request the application of an out-of-court resolution mechanism for disputes arising from the Contract with the competent bodies established by the Chambers of Commerce pursuant to Law no. of 29 December 1993. 580, as well as the mediation procedure pursuant to Legislative Decree no. 28/2010 and subsequent amendments, in accordance with the provisions applicable by the body selected by you, without prejudice to the possibility of making use of the voluntary negotiation procedures referred to in Article 2, paragraph II of the aforementioned Legislative Decree, as well as the complaint procedures provided for in the service charters.
Any invalidity or ineffectiveness ascertained in jurisdiction of one or more clauses of these Conditions of Sale does not affect the validity and effectiveness of the remaining provisions.
No delay or failure to exercise any powers, rights or remedies granted pursuant to these Conditions of Sale may be considered as a waiver of the same, nor may the partial exercise of such powers, rights or remedies prevent the further exercise of the same in the future.
Any communications to us must be made in writing to the address indicated at the beginning of these Conditions of Sale. Any communications to you may be made either to the e-mail address or to the postal address provided by you when sending the Order.
